Directive Principles of State Policy (DPSP) contains Articles 36-51 under Part-IV of Indian Constitution. They are borrowed from the Constitution of Ireland. However, the Irish do not own the idea as they themselves borrowed it from the Spanish Constitution. Dr B R Ambedkar described DPSP as ‘novel feature’ of Constitution. Any changes in Directive Principles require a Constitutional amendment which has to be passed by a special majority of both houses of the Parliament. This means that an amendment requires the approval of two-thirds of the members present and voting. However, the number of members voting should not be less than the simple majority of the house (Lok Sabha or Rajya Sabha).
Drawbacks in Directive Principles of State Policy
They are not enforceable by any court .It is conservative in nature. but the principles laid down therein are considered fundamental in the governance of the country, making it the duty of the State to apply these principles in making laws to establish a just society in the country.
Directive Principles of State Policy – Categories
Indian Constitution has not originally classified DPSPs but on the basis of their content and direction, they are usually classified into three categories-
- Socialistic Principles (Articles 38,39,39A,41,42,43,43A,47)
- Gandhian Principles (Articles 40,43,43B,46,47,48)
- Liberal-Intellectual Principles (Articles 44,45,48,49,50,51)
